Photon attackiert Photonwatch die 4. - Abmahnung und Klageandrohung wegen Urheberrechtsverstößen


Liebe Leser,

das ist eine interessante Woche, Photonwatch wird von der Photon richtig ernst genommen!


Der Postbote überbrachte uns heute wieder eine interessante Post. Im Auftrag der Photon haben die Anwälte eine Klageandrohung wegen Urheberrechtsverletzungen formuliert.

Im Kern geht es darum, dass die Photon ein Urheberrecht auf die zahlreichen Richtigstellungen beansprucht, die das Blatt in jeder Ausgabe so produziert. 

Der Anspruch von Photonwatch ist diese Richtigstellungen breit zu publizieren, damit die zahlreichen Opfer dieser "fortlaufenden Recherchefehler" nicht erst das Blatt kaufen müssen um andere hierüber zu informieren. 

Es wird interessant wie ein Gericht eine derartige Klage wertet. 

Dieser vierte Versuch der Einschüchterung ist schon etwas werthaltiger, als die anderen drei. Wir werden die Auseinandersetzung aufnehmen.

  1. Please see Photon's Newsletter from today. It comes with a picture of a PV installation in Madrid, and, as you can read, the caption says: "this rooftop PV system [...] will receive reduced FIT payments going forward".

    Well, the picture depicts a PV system which is NOT connected to the grid, and therefore does NOT get any FIT, which then, obviously, will NOT be reduced. Photon itself reported this fact earlier in the magazines. Had they kept their Spanish team with them, this mistake would not have happened. The Spanish team discovered many research mistakes during their work at Photon, and they were always mistreated, as the rest of the employees.

    19.02.2013: The Spanish government has published the revised FITs for PV installations installed between 2009 and 2011. The new FITs are based on reforms issued on February 2 that cut FITs for existing renewable energy generation systems according to inflation as well as the annual Consumer Price Index. The new tariffs are valid from Jan. 1, 2013, and will be applied to all PV installations connected to the grid in Spain from 2009 to 2011. The new tariffs for PV systems installed in 2009 will range from 35.66 euro cents (¢47.63) per kWh for integrated systems up to 20 kW installed in the first quarter to 33.56 euro cents per kWh for all non-integrated systems installed in the fourth quarter. As for 2010, the tariffs will range from 34.93 euro cents per kWh for integrated systems up to 20 kW installed in the first quarter to 26.56 euro cents per kWh for all non-integrated PV system installed in the fourth quarter. Tariffs connected to the grid in 2011, when inflation was highest, saw the greatest reductions: Tariffs for systems installed in 2011 will now range from 31.35 euro cents per KWh for integrated PV systems up to 20 kW installed in the first quarter to 12.49 euro cents per kWh for all non-integrated PV systems installed in the fourth quarter.
